Mom charged with child abuse after toddler found with a tattoo

Witnesses told police that she gave the child the tattoo while she was tattooing her own leg.

A Kentucky mother was arrested after authorities discovered her 22-month-old son with a tattoo, and found their home in what police described as "deplorable" conditions.

According to police reports, Brook McDaniel, age 27, was taken into custody by Kentucky State Police following a child abuse complaint in Columbia, Kentucky. During their visit, investigators found a black dot tattoo—described by witnesses as a "party dot"—on the toddler's right forearm, along with visible redness around the area.

Multiple witnesses told police that McDaniel gave the child the tattoo while she was tattooing her own leg, and that the child had "wanted the tattoo," according to court documents. When questioned, McDaniel confirmed she performed the tattoo, telling troopers her child approached and put his arm in the way of her tattoo gun while she was working.

Police also described the living conditions inside the home as "deplorable." The Kentucky Cabinet for Health and Family Services was contacted to investigate further.

McDaniel was charged with fourth-degree assault, classified as child abuse under Kentucky law. The state requires individuals to be at least 16 years old to receive a tattoo, and only with written parental consent. A conviction for fourth-degree assault carries up to 12 months in jail and a $500 fine.

She remains held at the Adair County Regional Jail on a $5,000 cash bond. As of now, she does not have a court date scheduled, and it is unclear whether she has legal representation. The investigation is ongoing.
